Washington, DC—The 5th Circuit upheld a Texas district court’s ruling that Deferred Action for Childhood Arrivals (DACA) violated the Administrative Procedures Act but sent the case back to the district court to review the DACA final rule set to go into effect on October 31. The 5th Circuit kept intact the stay allowing current DACA recipients to retain and renew their deferred action status and apply for work authorization. KIND President Wendy Young issued the following statement:
“For a decade, the DACA program has provided a lifeline to young people who came to the United States as children without legal status by allowing them to remain lawfully in the U.S., to work, and to pursue their dreams. These young people have been supporting their families, their communities, and this country, their home, in countless ways.
“After years of uncertainty and fear for the future, DACA recipients and other young people who have grown up in the United States deserve a lasting pathway to citizenship. KIND calls on Congress to pass the legislation which offers a meaningful solution for hundreds of thousands of young people who call the United States home.”
