EOIR’s interim final rule on Appellate Procedures for the Board of Immigration Appeals

KIND, alongside the Young Center for Immigrant Children’s Rights and 58 partner organizations, submitted a joint public comment opposing EOIR’s interim final rule on appellate procedures for the Board of Immigration Appeals. The comment raises serious concerns that the rule undermines due process by limiting meaningful appellate review, shortening filing timelines, and increasing summary dismissals—changes that disproportionately harm unaccompanied children and other vulnerable individuals. The coalition warns that the rule disregards critical child protection safeguards, risks wrongful removals, and could ultimately increase backlogs in federal courts. The organizations urge that the rule be withdrawn.
